Quotes and Availability
Quotes are based on the event information provided by the client, including the event date, location, schedule, venue, guest count, services requested, travel requirements, and equipment needs.
A quote or availability confirmation does not reserve an event date. Event dates remain available to other clients until the required agreement has been completed and any required retainer has been received.
Booking Confirmation
An event is not considered booked or confirmed until the client and Humecky Audio & Video LLC have entered into an event-service agreement and any required retainer or initial payment has been received.
Verbal discussions, text messages, emails, website submissions, quotes, and availability checks do not create a confirmed booking unless specifically stated in a completed written agreement.
Event-Service Agreements
Each booked event is governed by its own written agreement. The event-service agreement may include event-specific pricing, payment schedules, cancellation terms, rescheduling terms, travel charges, service hours, setup requirements, equipment details, overtime rates, client responsibilities, and other conditions.
If information on this website conflicts with a signed event-service agreement, the signed agreement will control.
Payments, Retainers, Cancellations, and Refunds
Payment requirements, retainers, due dates, cancellations, rescheduling, and refunds are governed by the applicable event-service agreement and the DJ Bad Brian Refund Policy.
Clients should review all payment and cancellation terms before completing a booking.
Client Responsibilities
Clients are responsible for providing accurate and complete event information. This includes the event date, location, venue requirements, event schedule, setup times, performance times, guest count, requested services, access instructions, and relevant venue policies.
Clients are responsible for notifying DJ Bad Brian of material changes to the event. Changes to the location, schedule, guest count, venue, services, or equipment requirements may result in additional charges or may require an updated agreement.
Venue Access and Setup
The client is responsible for arranging reasonable access to the venue and performance area. Access must allow sufficient time for unloading, setup, testing, performance, teardown, and loading.
The client should disclose stairs, elevators, long load-in distances, limited parking, restricted access, security procedures, required credentials, or other conditions that may affect setup and teardown.
Additional labor, equipment, or charges may be required when venue conditions differ significantly from the information provided during the quoting and booking process.
Electrical Power
Unless alternative arrangements are included in the event-service agreement, the client or venue must provide safe, grounded, and reliable electrical power that is suitable for the services and equipment being used.
DJ Bad Brian may refuse to connect equipment to unsafe, damaged, overloaded, improperly grounded, or otherwise unsuitable electrical systems.
Outdoor Events and Weather Protection
Outdoor events require adequate protection for performers, staff, and equipment. Protection may include a stable covered area that protects against rain, moisture, direct sunlight, excessive heat, dust, snow, and wind.
DJ Bad Brian reserves the right to delay setup, suspend services, relocate equipment, or discontinue services when weather or outdoor conditions create a risk to people or equipment.
The client remains responsible for providing the weather protection required by the event-service agreement.
Venue Rules and Permissions
The client is responsible for obtaining any permissions, approvals, licenses, or venue authorizations required for the event.
This may include permission for amplified sound, lighting effects, haze, fog, special effects, equipment placement, electrical access, load-in access, or extended event hours.
DJ Bad Brian will comply with reasonable venue rules, sound limits, fire codes, safety requirements, and lawful instructions from venue management.
Equipment and Guest Conduct
Guests and unauthorized persons may not touch, move, climb on, lean against, disconnect, or operate DJ, sound, lighting, electrical, video, or production equipment.
The client may be responsible for damage caused by the client, guests, venue staff, vendors, or other persons attending or working at the event.
Drinks, food, decorations, and other items should not be placed on or near equipment unless approved by DJ Bad Brian.
Safety and Right to Suspend Services
DJ Bad Brian reserves the right to delay, suspend, modify, or discontinue services when conditions become unsafe, unlawful, abusive, threatening, or likely to damage equipment.
Unsafe conditions may include severe weather, unsafe electrical power, structural hazards, blocked exits, excessive crowding, violent or threatening behavior, intoxicated individuals interfering with equipment, unsafe venue conditions, or failure to follow reasonable safety instructions.
Music Requests and Content
DJ Bad Brian may accept music requests when appropriate for the event, available music library, schedule, and client instructions.
Submission of a request does not guarantee that a particular song, artist, announcement, activity, or performance element will be included.
The client is responsible for communicating restrictions involving explicit content, clean music requirements, do-not-play selections, religious expectations, school policies, cultural considerations, or venue requirements before the event.
Event Schedule and Overtime
Services are provided during the times listed in the applicable event-service agreement.
Requests to begin earlier, continue later, or add services may be subject to availability and additional charges. Overtime is not guaranteed unless approved by DJ Bad Brian.
Photography and Media
Event photographs or video may be used for portfolio, website, or promotional purposes only when allowed by the applicable agreement, venue rules, and any permissions obtained for the event.
Clients may communicate privacy concerns or restrictions before the event. DJ Bad Brian will make reasonable efforts to honor agreed-upon photography and media restrictions.
Third-Party Services and Websites
This website may include links, embedded content, maps, calendars, videos, social media features, payment services, or other services provided by third parties.
DJ Bad Brian and Humecky Audio & Video LLC do not control and are not responsible for the availability, content, security, privacy policies, or practices of third-party services.
Website Availability
DJ Bad Brian does not guarantee that this website will always be available, uninterrupted, secure, or free of errors.
Website access may be temporarily limited because of maintenance, hosting issues, software updates, internet outages, security concerns, or other circumstances.
Limitation of Liability
To the maximum extent permitted by applicable law, DJ Bad Brian and Humecky Audio & Video LLC are not responsible for indirect, incidental, special, or consequential damages arising from use of this website or from circumstances beyond reasonable control.
Circumstances beyond reasonable control may include severe weather, natural disasters, road closures, power failures, internet or communications outages, venue restrictions, government actions, emergencies, illness, accidents, equipment failure despite reasonable maintenance, or actions of third parties.
Any liability relating to booked event services will be governed by the applicable event-service agreement and, to the extent permitted by law, will not exceed the amount paid for the affected services.
