Refund & Cancellation Policy
Information about booking retainers, cancellations, rescheduling, weather, and refunds for DJ Bad Brian events.

This policy provides a general summary of the refund, cancellation, and rescheduling terms used by DJ Bad Brian and Humecky Audio & Video LLC. The terms contained in your signed service agreement will control if there is any difference between that agreement and this webpage.
Booking retainers
An event date is not officially reserved until the required booking retainer and signed service agreement have been received.
Booking retainers are nonrefundable. The booking retainer compensates DJ Bad Brian for reserving the event date, declining other potential bookings, beginning event preparation, communicating with the client, and performing administrative and planning work.
The booking retainer will be applied toward the total price of the contracted services.
Remaining balance
The remaining balance must be paid by the due date listed in the signed service agreement. Failure to make payment when due may be treated as a client cancellation and may result in the release of the reserved event date.
Client cancellations
All cancellation requests must be submitted in writing. Cancellation is effective when written notice is received and acknowledged by DJ Bad Brian.
If the client cancels the event, the following terms generally apply:
- More than 90 days before the event: Payments made beyond the nonrefundable booking retainer will be refunded.
- 30 to 90 days before the event: The booking retainer remains nonrefundable. Any additional amount due or refundable will be determined by the signed service agreement.
- Fewer than 30 days before the event: The full contracted service price may be due and nonrefundable as provided in the signed service agreement.
Any custom purchases, special-order equipment, licensing fees, subcontractor expenses, travel reservations, or other nonrecoverable costs incurred specifically for the event are also nonrefundable.
Rescheduling
DJ Bad Brian will make reasonable efforts to accommodate requests to reschedule an event. Rescheduling is subject to availability and is not guaranteed.
When the requested replacement date is available, payments may be transferred to one new event date occurring within 12 months of the original event date.
A rescheduling fee or price adjustment may apply if the new date, location, service requirements, travel requirements, event duration, or current package price differs from the original booking.
If DJ Bad Brian is unavailable for the requested replacement date, the change will normally be treated as a client cancellation under the cancellation terms of the signed service agreement.
Changes to event details
Changes to the event location, start time, end time, services, equipment, guest count, or performance requirements must be approved in writing.
Additional charges may apply when requested changes increase travel, labor, equipment, preparation, setup, teardown, or performance time.
Weather and outdoor events
The client is responsible for providing a safe, stable, and weather-protected performance area for outdoor events.
Adequate protection must be provided against rain, snow, excessive wind, direct moisture, extreme temperatures, unstable surfaces, and other conditions that could endanger guests, staff, performers, or equipment.
DJ Bad Brian may delay, suspend, relocate, modify, or discontinue services when weather or site conditions are unsafe.
A weather-related decision to cancel, delay, or discontinue an event does not automatically qualify for a refund when DJ Bad Brian was present, prepared to perform, or prevented from performing by conditions outside the company’s reasonable control.
Unsafe working conditions
DJ Bad Brian may stop, suspend, or refuse services when conditions present a reasonable risk to guests, staff, performers, or equipment.
Unsafe conditions may include:
- Severe weather or inadequate weather protection
- Unsafe or insufficient electrical power
- Unstable staging, flooring, tables, or performance surfaces
- Threatening, abusive, or violent behavior
- Excessive intoxication or uncontrolled guest behavior
- Harassment of DJ Bad Brian, staff, or other vendors
- Illegal activity occurring near the performance area
- Conditions that could damage equipment or cause injury
No refund will normally be issued when services are shortened, suspended, or ended because of unsafe conditions caused by the client, venue, guests, or circumstances outside DJ Bad Brian’s reasonable control.
Venue and event restrictions
The client is responsible for confirming venue access, electrical requirements, loading arrangements, sound restrictions, setup times, insurance requirements, permits, curfews, and other venue rules before the event.
Refunds will not normally be provided when services cannot be performed because the venue:
- Denies access to the event or performance area
- Prohibits contracted equipment or services
- Does not provide safe or suitable electrical power
- Changes the permitted setup or performance time
- Imposes restrictions that were not disclosed before booking
- Otherwise prevents DJ Bad Brian from performing
Travel and road conditions
Travel requirements and charges will be listed in the service agreement or event quote.
DJ Bad Brian will make reasonable efforts to arrive and perform as scheduled. However, services may be delayed, modified, or cancelled when road closures, hazardous travel conditions, government restrictions, vehicle emergencies, or other serious transportation issues make travel unsafe or impossible.
Cancellation by DJ Bad Brian
If DJ Bad Brian is unable to perform because of illness, emergency, equipment loss, transportation failure, or another serious circumstance, reasonable efforts may be made to arrange a qualified substitute with the client’s approval.
If DJ Bad Brian cancels the contracted services and no acceptable substitute is provided, payments received for services that were not performed will be refunded.
Any refund will be limited to amounts paid directly to DJ Bad Brian or Humecky Audio & Video LLC for the affected services.
Events beyond either party’s control
Natural disasters, government restrictions, public emergencies, widespread power outages, road closures, severe weather, venue closures, acts of war, civil disturbances, or other circumstances beyond the reasonable control of either party will be handled according to the force majeure provisions of the signed service agreement.
When reasonably possible, DJ Bad Brian and the client will first attempt to reschedule the event or apply eligible payments as credit toward a replacement date.
Refund processing
Approved refunds will be returned to the original payment method whenever practical.
Processing times may vary depending on the payment provider, bank, or financial institution.
Transaction charges, processing fees, special-order expenses, and nonrecoverable third-party costs may be deducted where permitted by the signed service agreement and applicable law.
Chargebacks and payment disputes
Clients are encouraged to contact DJ Bad Brian before initiating a chargeback or payment dispute so that any concern can be reviewed and addressed.
Filing a chargeback does not cancel the client’s obligations under the signed service agreement. DJ Bad Brian may provide the signed agreement, invoices, payment records, communications, planning records, and proof of services to the payment provider when responding to a dispute.
